CAR RENTAL RULES AND REGULATIONS (Appendix No. 2 to the Car Rental Agreement.)
§1 Conditions of renting a car:
1. Making a car reservation by the Customer via the website www.autonaczas.net.pl and receiving a confirmation of reservation acceptance.
2. Presenting by the Customer his or her passport, and driving license held for a period of at least two years (in case of a minibus, subaru legacy, skoda octavia,audi A4 and porsche cayman – three years). The driver of these cars can not be a person younger than 25 years.
3. Signing of the Car Rental Agreement, acceptance protocol and the Car Rental Rules and Regulations.
4. Payment in advance of the total amount for car rental and making a deposit as specified in the price list. At least part of payment or deposit have to be payed by customers credit or debit card.
§2 Customer’s obligations:
1. Use the car appropriately and in accordance with its intended purpose. Pay attention to the indications of instruments, oil level, the operation of lighting and react accordingly.
2. Do not allow driving a car to people other than those specified in the Car Rental Agreement and meeting the conditions listed in § 1 point 2
3. Follow road traffic regulations and cover all costs resulting from non-compliance (this applies mainly to damage to the vehicle, damage caused to third parties, parking tickets, parking charges and road charges, as well as the costs of calls and correspondence related to this).
4. Do not leave the registration card and keys in the car.
5. Protect the car against theft by means of leaving it in guarded places; turn on the alarm and blockade, if the car is equipped with such devices.
6. Immediately inform the Car Rental Company about any defects noticed.
7. It is absolutely forbidden to smoke in the car.
8. For the time of going abroad, the Customer is obligated to equip the car in accordance with the rules in force in the country of destination (e.g. additional waistcoats or a warning triangle, vignette stickers for toll roads, ecological stickers etc.) and to purchase additional insurance, if it is required in that country.
9. Return the car clean and with the fuel tank filled up, if the car was rented in such a condition.
10. Ensure that the telephone number provided in the Car Rental Agreement is active for the entire period of car rental.
§3 Responsibilities of the rental company:
1. Rent to the Customer the car in a working condition, having current and up-to-date technical inspections, civil liability insurance/Auto Casco insurance/personal accident insurance, and appropriate equipment required in Poland.
2. In case of a breakdown or collision, provide help as part of the assistance insurance.
3. Repair the car at its cost if not through the fault of the customer or if the damage is repaired as part of guarantee obligations of the manufacturer or from insurance. The Rental is deciding about reporting the damage from the AC policy.
§4 Additional costs (net prices, Tax 23%):
1. Pick up or return the car to the city of Poznań – PLN 19; at the airport Poznań-Ławica or bus and train station Poznań Główny - PLN 0
2. Service outside working hours – PLN 29
3. Satellite navigation, child safety seat, snow chains – PLN 10/day, trunk on the roof - PLN 20/day
4. Pick up or return of the car in a town other than Poznań – PLN 200 up to 150 km, and PLN 1.50 per every kilometer above this limit.
5. Delayed return of the car by more than one hour – payment as for the next day of rental.
6. Return of the dirty car (outside or inside) if it was released clean – A, B, C class – PLN 60, other classes – PLN 80.
7. Wiping of the car instead of washing – class A,B,C – PLN 200, other classes – PLN 300
8. Payment for every kilometer over the limit in individual car classes: A – PLN 0.50; B – PLN 0.60; SMALL VAN - PLN 0,70; C – PLN 0.80;
PREMIUM, MINIVAN - PLN 0,90; BUS, BIG VAN – PLN 1.00
9. Loss of the registration card, keys, remote control or registration plate(s) – the actual cost of obtaining or redemption of these items and payment for every day of parking caused by the said events – according to the rates as for rental with a limit 150 kilometers.
10. The necessity to wash the upholstery – PLN 300
11. Smoking in the car – PLN 1000
12. Fuel tank not full – actual cost of fuel and PLN 50 for tanking.
13. The fee for providing customer data to authorized bodies (eg. in the case of the mandate) – PLN 60
§5 Collision or car theft:
1. In the event of a collision or theft of the vehicle, the Client is obliged to call the police and immediately notify Lending event.
2. The customer is required to obtain and provide to the Lending documents confirming the circumstances of the collision, the data of the participants, the statement perpetrators of guilt and a police protocol.
§6 Material liability you owe Lending (net prices, Tax 23%):
1. Damage caused during the period when the car was in possession of the customer, are covered by insurance, with reservation §6 pkt 2,3,4,5
2. Customer's own share in the liquidation of damages is up to PLN 1500. This amount can be reduced to PLN 750. after bringing before giving the car an additional fee of PLN 40 for 1 day, PLN 70 for 2 days, PLN 90 for 3 days and PLN 10 for each, the next day. If the damage is the fault of another participant in the event, then the customer is not financially responsible, as far as provide Lending data perpetrator, his declaration of guilt and a police protocol.
3. In the case of theft or total loss, repealed the principles set out in § 6 p1,2, and the Client undertakes to pay for Lending amount of PLN 4000
4. The provisions of § 6 p1,2,3 shall not apply if the damage occurs during use of the vehicle in influence of alcohol or drugs, as well as when the vehicle is stolen along with proof of registration or key. In this case the customer is obliged to fully cover all costs associated with restoring the car to its original condition or redemption of the vehicle at the market price.
5. Towards the cost of repairing the damage, for which - at least partially - the Customer's responsibility, and the need for refueling or equipment rental will stop the return of the deposit. Repair costs exceeding the amount of the deposit, the customer will return Lending within 7 days of the summons. The rest of the deposit, which will not be used to cover the damage, will be immediately returned to the customer.
§7 Final Provisions:
1. Issue and return of the vehicle will be on time, not later and not before, at a place determined by the Rental Car Agreement.
2. After returning the car, documents and keys, the client receives a deposit paid in whole or deduction for any damage or missing pieces of equipment.
3. The rental company has the right to refuse to rent a car without giving a reason.
4. Rental has the right to pick up the car before the deadline of hire if the customer is in arrears with payments, breach of regulations or the driving license will be retained. Also in the case of revealing the driving of a car in the state indicating the consumption of alcohol or intoxicants, the car will be immediately and without any notice received, and the customer is not entitled to a refund of the remaining amount.
5. In the event of resignation from renting a reserved car or failing to pick up, the following fees are charged:
Within 30 days before the date of commencement of the lease, the resignation is not subject to a fee.
Within 29 to 15 days before the date of commencement of the rental fee is 30% of the total cost of the lease.
Within 14 to 8 days before the date of commencement of the rental fee is 50% of the total cost of the lease.
Within 7 days before the date of commencement of the rental fee is 75% of the total cost of the lease.
If the Customer fails to submit without canceling the reservation, the fee is 100% of the total cost of the lease.
Liabilities for the advance payment are treated separately and in accordance with the provisions of the Civil Code.
6. A change or cancellation should be made in writing (e-mail) and confirmed by an employee of the Autonaczas rental company.
7. The rental company is not responsible for the losses of customers and the benefits they have not achieved, which arose as a result of the failure of the rented car
8. The rental company reserves the right to deliver a car other than ordered, without consulting the client, if it does not increase the rental price.
9. In the event of disputes and the impossibility of their amicable settlement, the parties submit to the judgment of the competent local court.
